We provide advice, counseling, and litigation services for employees dealing with a hostile work environment or bullying.  Typically, a hostile work environment is carried out in conjunction with retaliation and originates with a discrimination or sexual harassment claim.  Our employment law attorney helps employees navigate their way through the work day when they are experiencing hostility or are being targeted.  In addition to coaching and counseling employees about how to handle working in a hostile and toxic environment, we also negotiate severance and settlement agreements and if necessary, provide representation in litigation.


When an employee has been terminated based on a protected status and/or as a result of retaliation, we represent the employee in litigation and assert a wrongful termination claim in additional to discrimination, harassment, retaliation and/or hostile work environment claims.  We attempt to negotiate settlement of the claims and also provide full legal representation in arbitration or litigation from beginning to end.

When employees have been disciplined or placed on a Performance Improvement Plan (PIP), our attorney provides coaching and counseling to help them protect their rights and their job. If the employee no longer wants to be employed with the employer, we try to negotiate a severance agreement and advise out clients regarding best practices while continuing to work until an agreement is reached. It can be very difficult to continue working while bringing legal claims and we provide daily support and coaching through the situation.  


We also draft, review and provide legal advice regarding employment, severance, non-competition, confidentiality, trade secrets, and non-solicitation agreements. We represent employees who have received cease and desist letters and/or whose former employers are threatening to file, or have already filed, a lawsuit against the employee.

We represent employees at all levels of appeal for unemployment benefits.  Our employment law attorney has handled countless appeals being heard by the Office of Administrative Hearings,  Commissioner Petitions for Review, and Petitions for Review to Superior Court.


We also represent union members in  union grievances, to the extent the process allows us to, and provide legal representation and counseling at every step of the grievance, including arbitration.  In addition, if the union is not adequately representing its member, we provide representation relating to the union's failure.

CONTRACTS

We draft and revise construction contracts for homeowners, contractors, subcontractors, and suppliers.  We also provide advice regarding interpreting contract provisions when our clients have questions or are in a dispute during their project.  Our attorney's advice and representation includes topics such as change orders, extras, delays, incomplete or abandoned work, construction defect, claims against contractor's bonds, and liens on real property.  We offer single appointments for advice and guidance, draft demand letters, negotiate settlement, and also provide full legal representation in arbitration and court.

LIENS

We draft and record liens against real property under RCW 60.04. Our lien drafting and recording normally costs our clients less than if they used a specialty lien service, which typically will not have an attorney on staff and cannot give legal advice. We also defend against liens, file removal actions, and bring actions under the frivolous lien statute. If we file your lien, we will track its status and remind you of the date the lien will expire if a lawsuit is not filed.  We can also represent you in turning your lien into a lien foreclosure action in Superior Court, in which you are entitled to an award of attorney's fees and costs if you win. We offer legal representation that ranges from single one-hour advice appointments to full representation in lien actions.

We litigate construction cases involving breach of contract, construction defects, delays, change orders, non-payment, coordination of work, and liens. Our attorney has represented clients in numerous arbitration hearings and in court at every stage, from filing the initial complaint, to discovery, to motions for summary judgment, all the way through verdict at trial.

ADMINISTRATIVE APPEALS

We provide legal representation and advocacy for our clients who are appealing state agency decisions, such as Employment Security (unemployment), Department of Social and Health Services (DSHS), Child Protective Services (CPS), Department of Financial Institutions (DFI),  Department of Licensing (DOL), and Labor and Industries (L&I).  Our attorney regularly appears in actions being heard by the Office of Administrative Hearings  (OAH) and also routinely files Petitions for Review to the next agency level or to Superior Court.  We have an excellent appellate record in appealing state agency decisions.
